Legal · 06 · Data Protection · Art. 22 right-of-challenge
The Data (Use and Access) Act 2025 reframed UK GDPR Article 22 from “prohibition with exceptions” to “right of challenge with safeguards.” BRMSTE makes the right operational. Below: what automated decisions the substrate makes, and how a human reviewer can be invoked.

What the substrate automates · the entire inventory
The /entry page automatically determines whether you have accepted the Visitor Compact (via the brmste-entry cookie). This is a binary automated check — no decision-affecting profiling.
If you operate the BRMSTE API, the BRMfrontierK kernel router automatically routes your call to the appropriate model class based on the query's category (latency-sensitive, reasoning-heavy, etc.). The routing decision is purely technical; it does not produce a determination about you.
The verifier-daemon automatically refuses calls that would breach the Acceptable Use Policy (Article 5 floor + BRMSTE additions). The refusal is recorded as a class=termination StageRecord on chain.
If your operator-contract triggers Annex III high-risk deployment (recruitment, credit scoring, biometric ID, etc.), the substrate runs full Art. 9-15 conformity assessment + Art. 26 deployer obligations. Every decision is logged with the operator's identity, the verifier-daemon's evaluation, and the chain head.
Safeguards · four guarantees
How to invoke the right
Send an email to hello@shravanbansal.comwith subject “Art 22 challenge”. Include: the silicon-DNA prefix of the affected session (visible in the SiliconChain footer), the date of the decision, and a one-paragraph summary of what was decided and why you contest it.
A human reviewer will examine the decision within five working days. The review outcome — uphold or overturn — is sent to you in writing and recorded on chain as a corrective StageRecord. If you remain dissatisfied, the ICO complaint route is preserved.
“Every automated decision can be challenged. Every challenge gets a human reviewer. Every reviewer outcome is on chain. The right is not theoretical; the substrate honours it.”
